Terms of service

Who we are

ReleaseRight is operated by [Company legal name], a Florida [entity type] (“ReleaseRight,” “we,” or “us”), [Business mailing address]. These terms are an agreement between us and the practice or individual that creates an account (“you”). By creating an account or using ReleaseRight, you agree to them.

What ReleaseRight is

ReleaseRight is decision-support software. It applies Florida and federal law to the answers you give about a records request and produces a determination, supporting citations, checklists, and draft letters. ReleaseRight does not provide legal advice, does not create an attorney-client relationship, and does not replace your professional judgment or the advice of an attorney. See our disclaimer.

Who can use it

ReleaseRight is for licensed health care professionals and the practices that employ them, and for staff those practices authorize. You must be at least 18 years old. You’re responsible for everyone you invite to your practice account and for keeping passwords confidential.

Your responsibilities

Plans, trials, and billing

New practices get a free 14-day trial of the Practice plan with no payment card required. After the trial, continued use requires a paid plan. Paid plans renew automatically each month or year until canceled. Payments are processed by Stripe, and we never see or store your full card number. We’ll give you at least 30 days’ notice before a price change takes effect on your plan.

Plan limits, such as the number of clinicians and monthly determinations, are listed on our pricing page. If your trial ends or a payment fails, you can still sign in and view your saved history, but you can’t save new determinations until you choose a plan.

Cancellation and refunds

You can cancel anytime from the billing page in the app. Your plan stays active until the end of the period you’ve paid for, and it won’t renew. We don’t give refunds for partial months. Annual plans can be refunded in full if you cancel within 14 days of your first annual payment; email [email protected] to request one.

Acceptable use

Don’t misuse ReleaseRight. That includes trying to access another practice’s data, probing or disrupting the service, reverse engineering it, reselling access, or using it in violation of law. We may suspend accounts that do.

Your data and ours

You own the information your practice enters. You give us permission to store and process it to provide the service, as described in our privacy policy. We own the software, the rule sets, and the content of the letter templates. You may use the letters ReleaseRight generates in your practice without restriction.

Availability and changes

We work to keep ReleaseRight available and accurate, and we update the rules when the law changes, but we don’t guarantee uninterrupted service. We may change or discontinue features. If we discontinue the service, we’ll give at least 30 days’ notice and let you export your audit log.

Disclaimer of warranties

ReleaseRight is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that any determination is correct for your circumstances.

Limitation of liability

To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to ReleaseRight is limited to the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to defend and indemnify us against claims arising from your use of ReleaseRight in violation of these terms, including entering patient-identifying information or releasing or withholding records without exercising your own professional judgment.

Ending the agreement

You can close your account anytime. We may suspend or close an account that violates these terms. Sections that by their nature should survive, including warranties, liability limits, and indemnification, survive termination.

Governing law

These terms are governed by Florida law. Any dispute will be resolved in the state or federal courts located in [County] County, Florida, and both parties consent to that jurisdiction.

Changes to these terms

We may update these terms. We’ll post the new version here with a new date and, for material changes, notify account owners by email or in the app at least 30 days in advance.
